Vroom International Consumable Products Delivery Company L.L.C (“Vroom”) is committed to protecting the privacy of all users of our website www.tryvroom.com  or mobile applications (together, the “Sites”).

Please read the following privacy policy that explains how we collect, share, use, process, protect your information, and how you can exercise your privacy rights. If you choose to use our service, then you agree to the collection and use your information in relation to this policy. We will not use or share your information with anyone except as described in this privacy policy. If you have any questions or concerns about our use of your information, please contact us using the contact details provided at the bottom of this page.

This privacy policy constitutes an integral part of the terms and conditions (“T&C“) that apply with respect to your use of the Sites. In the event of any omission in the clauses outlined in the privacy policy or any provision that is not mentioned herein, the User shall refer to and abide by the provisions set forth in the T&C, which shall govern the overall legal relationship between Vroom and the User.

  • Users’ Information:

Vroom will collect the following information from users when they use our services: first name, last name, street address, area and city, phone and contact numbers, e-mail address, GPS location, item image, usage data, data communicated while using the service, and the basic information required to complete the delivery. In addition, Vroom has the right to collect users’ information regarding Vroom account holders, past Vroom orders, including without limitation social networking preferences (e.g. pages you “Like” or “Recommend”). Moreover, we may collect information about your usage of the Sites and information about you from any messages you post on the Sites or when you contact us or provide us with feedback, including via email, letter, phone or chat function. If you contact us by phone or if we reach out to you by phone, we record the call and make notes in relation to the call in order to ensure compliance with our service terms and conditions, to maintain customer service standards and for training and service improvement purposes. (“Personally Identifiable Information” or “PII“).

Non-Personally Identifiable Information (“Non-PII“) is aggregated information, demographic information and any other information that does not reveal your specific identity. We and our third-party service providers may collect Non-PII from you, including your computer or mobile device type, screen resolution, operating system version, Internet browser and demographic data, for example your location, gender and date of birth, and we may aggregate PII in a manner such that the end-party does not personally identify you or any other user of the Sites, for example, by using PII to calculate the percentage of our users who have a particular telephone area code.

IP Addresses are the Internet Protocol addresses (“IP”) of the devices that you are using. Your IP Address is automatically assigned to the device that you are using by your internet service provider. This number is identified and logged automatically in our server log files whenever users visit the Sites, along with the time(s) of such visit(s) and the page(s) that were visited. Collecting IP Addresses is standard practice on the Internet and is done automatically by most websites and apps.

Please note that unless specified otherwise, all information requested by us is mandatory and failure to provide this information may make it impossible to provide our services. In cases where the Sites specifically states that some information is not mandatory, users are free not to communicate this information without consequences to the availability or the functioning of the service.

  • Your Rights:

Under data protection law, you have a number of rights concerning the information we hold about you. If you wish to exercise any of these rights, please contact us by using the contact details set out below this page.

  1. The right to be informed. You have the right to be provided with information about how we use your information. This is why we are providing you with the information in this policy.
  2. The right of access. You have the right to obtain access to your information. This will enable you, for example, to check that we are using your information in accordance with data protection law. If you wish to access the information we hold about you in this way, please get in touch with us (See Contact Section).
  3. The right to rectification. You are entitled to have your information corrected if it is inaccurate or incomplete. You can request that we rectify any errors in information that we hold by contacting us (See Contact Section).
  4. The right to erasure. In simple terms, enables you to request the deletion or removal of certain of the information that we hold about you if it is inaccurate or incomplete by contacting us (See Contact Section).
  5. The right to withdraw consent. If you have given your consent to anything we do with your information (i.e. we rely on consent as a legal basis for processing your information), you have the right to withdraw that consent at any time. You can delete your information any time from the profile page, by contacting us (See Contact Section), or disabling cookies. Withdrawing consent will not however make unlawful our use of your information while consent had been apparent.
  • Use of your information:

The information concerning the users are collected to allow Vroom to provide its services, as well as for the following purposes: Contacting the user, Registration and authentication, Access to third party services’ accounts, Marketing and promotion,  Analytics, Interaction with support and feedback platforms, Managing support and contact requests, Displaying content from external platforms, Managing contacts and sending messages, Hosting and backend infrastructure, Remarketing and behavioral targeting, Handling payments, Issuing invoices, Interaction with external social networks and platforms, Interaction with live chat platforms, Infrastructure monitoring, User database management, Commercial affiliation, Tag Management, Data transfer outside Kuwait, Fulfilling statutory or contractual obligations, Protecting the rights of parties and related stakeholders, Insurance, After-sales service, and Operating our registered business. If you refuse to allow us to collect your information, we may not be able to provide our services.

In addition, we collect and uses PII to create users’ Vroom accounts, to communicate with users about Vroom services, to offer users additional services, promotions and special offers and to charge for purchases made through Vroom. Users may affirmatively opt-out of receiving promotional communications from Vroom Sites, or by contacting us (See Contact Section).

Please note that Vroom may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. We may also use web analytics software to track and analyze traffic on the Sites in connection with Vroom advertising and promotion of Vroom services. Vroom may publish these statistics or share them with third-parties without including personal information.

Moreover, as Non-PII does not personally identify you, we may use such information for any purpose, and we reserve the right to share such Non-PII, which does not personally identify you, with other third-parties, for any purpose. In some instances, we may combine Non-PII with PII (such as combining your name with your geographical location). If we do combine any Non-PII with PII, the combined information will be treated by us as PII hereunder as long as it is so combined.

We use IP addresses for purposes such as calculating Sites usage levels, helping diagnose server problems, and administering the Sites. We may also use and disclose IP Addresses for all the purposes for which we use and disclose PII. Please note that we treat IP Addresses, server log files and related information as Non-PII, except where we are required to do otherwise under applicable law.

Where we are under a legal obligation to do so, we may use your information:

  1. to improve the effectiveness and quality of service that our users can expect from us in the future;
  2. to tailor content that we or our third-party or advertising partners display to you.
  3. to enable our user support team to help you with any enquiries or complaints in the most efficient way possible;
  4. to contact you for your views and feedback on our services and to notify you if there are any important changes or developments to the Sites or our services, including letting you know that our services are operating in a new area, where you have asked us to do so;
  5. to analyze your activity on the Sites so that we can administer, support, improve and develop our business and for statistical and analytical purposes and to help us to prevent fraud;
  6. to enforce our contractual terms with you and any other agreement, and for the exercise or defense of legal claims and to protect the rights of Vroom, partners, riders, or others (including to prevent fraud);
  7. if you submit comments and feedback regarding the Sites and the services, we may use such comments and feedback on the Sites and in any marketing or advertising materials. We will only identify you for this purpose by your first name and the city in which you live; and
  8. where you have chosen to receive notifications from us through our mobile application, we may send you notifications relating to the services that you have requested from us and information about our services and offers. You can choose to stop receiving such notifications from us at any time by changing your preferences on your mobile device.
  • Your Phone Number:

To register for an account, we require you to supply us with your phone number, or other information needed to contact you online, email and over the phone. We use your phone number and other contact information you provide us with to confirm your order and to communicate with you in case of an order problem, so one cannot register without a phone number. If you supply us with your phone number, you may later access it, update it, modify it and delete any inaccuracies by accessing your profile page. You will not be able to register or use our service or place orders without providing us with your accurate phone number.

  • Order Placement Information:

We will use part of PII that is required to complete the delivery such as (name, surname, order delivery address and phone number) with the other person (the “Beneficiary” or “Beneficiaries”) from which you have placed an order. Your personal information will be used to notify you of your order status. PII is treated as confidential, we do not sell and will not divulge your personal information to third-parties, unless compelled by applicable legislation or the cases that is specify in the Privacy Policy.

  • Payment Information:

When making a purchase on the Sites, you must choose a payment method. Vroom does not collect or retain any of your debit/credit card details. Payment transactions are handled by a third-party payment service provider, namely ‘TAP COMPANY.’ Users shall review TAP’S terms and conditions, as well as their privacy policy before using their service:

  • Information Processing:

Vroom only processes the information that we collect about you if there is a reason for doing so, and if that reason is permitted under applicable data protection laws. Vroom will have a lawful basis for processing your information if we: need to process your information in order to provide you with the service you have requested or to enter into a contract; have your consent; have a justifiable reason for processing your information; or are under a legal obligation to do so.

Where we need to provide you with the service you have requested or to enter into a contract, we use your information to:

  1. enable us to provide you with access to the relevant parts of the Sites;
  2. supply the services you have requested in accordance with our service T&C;
  3. enable us to collect payment from you; and
  4. contact you if necessary, concerning our services, such as to resolve issues you may have with your order.

We will also analyze the information that we collected about your use of our services from your location data to create profiles relating to you and for you. This means that we may make certain assumptions about what you may be interested in and use this, for example, to send you more tailored marketing communications, to let you know about special offers which we think you may be interested in. You have certain rights in relation to this type of processing. Please see ‘Your Rights’ section.

  • Disclosing Your PII:

Vroom has the right to share your information internally, and it will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this privacy policy when it is transferred to third-parties. Please note that Vroom does not sell the information it collects to third-parties.

Vroom has also the right to disclose certain information with third-parties for the following reasons; (i) To facilitate our service; (ii) To provide the service on our behalf; (iii) To perform service-related services; or (iv) To assist us in analyzing how our service is used. However, these third-parties are obligated not to disclose or use the information for any other purpose.

In general, the types of third-party service providers whom we share your PII with are:

  1. Riders, and mail carriers so they can deliver your order to you;
  2. IT service providers (including cloud providers, and technical service providers) for the purposes of assisting us in information processing, storage and analysis as well as for maintenance or issuing invoices electronically and other relevant electronic services, if applicable; Vroom will also share the collected PII to third-party vendors and service providers with whom Vroom works to provide application programming interfaces, and other functions for the Sitesin connection with the delivery of Vroom services.
  3. Customer support partners and communications agencies who will help us to resolve any issues you may have with our services; and
  4. Payment providers (including online payment providers and fraud detection providers) for the purposes of providing services to us, for example when they process information such as credit card payments for us, provide support services to you or carry out fraud checks for us;
  5. Marketing and advertising partners so that they can ensure that you see advertising which is more relevant to you and send you email marketing on our behalf.
  6. The Beneficiaries, the person who you have placed your order with.
  7. Professional advisors.
  8. An affiliate or other third-party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).

Notwithstanding, any other provision of this privacy policy to the contrary, we reserve the right to disclose your personal information if we believe that we are required to do so (i) by law; (ii) to comply with legal process or attorney requests, governmental or court orders; (iii) to enforce our terms of Service; (iv) to protect our operations or those of any affiliated entities; (v) to protect the rights, privacy, safety or property of Vroom, any affiliated entities, you or others; and (vi) to permit us to pursue available remedies or limit the damages that we may sustain; and (vii) If the information relates to actual or threatened harmful conduct.

  • Marketing:

It is very important to us that we provide you with the highest level of service. In order to help us do this, from time to time we may send you details of products, services, discounts, promotions and campaigns, which we think, may be of interest to you. We may send you marketing communications with your consent. If at any time you do not wish to receive these details and wish to unsubscribe from marketing communications, contact us via e-mail or log onto your profile to change your relevant settings.

  • Using Advertising Companies to Serve Ads for Us:

These companies may employ cookies and action tags to measure advertising effectiveness. They may also use this technology to serve specialized or relevant advertising content and/or recommendations to you on the Sites. Any information that these third-parties collect via cookies and action tags is completely anonymous and does not contain any personal contact information.

  • Navigation and Click stream Data:

As you browse our Sites, we gather navigational and click stream data that shows which pages you have visited, what kind of features you have used or how long you have stayed on a particular page etc. This information will not reveal your identity or be linked to you personally. We use this information to complete, support and analyze your purchases from us; to facilitate and improve your use of the Sites; to comply with any requirements of law; to serve, or have a third-party serve specialized or relevant advertising content and/or recommendations to you on the Sites and for internal purposes. This information may be disclosed only to our staff and to third-parties involved in the completion of your transaction, the delivery of your order, and the analysis and support of your use of the Sites.

  • Usage Data:

Information is collected automatically through using our application (or third-party services employed in this application), which can include: the IP addresses or domain names of the devices utilized by the users who use this application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the user, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the user’s IT environment.

  • Cookies:

When you visit our Sites, our server sends a “cookie.” This cookie is a small packet of information that identifies you as a user of our system. Cookies save you time by retaining your contact information. Cookies do not deliver viruses, and can only be read by the server that sent you the cookie. You have the ability to accept or decline cookies by modifying the settings in your browser. Please bear in mind however, that you may not be able to use all the features of our Sites or not function properly, if cookies are disabled.

Vroom will use cookies to help us improving our services and security, as well as remember and enhance users’ experience on the Sites. For example, when users with Vroom accounts return to the Sites, cookies identify those users and allow the Sites to provide certain user-specific information such as Vroom login information, choice of Sites language and country selection in addition to any other information we might collect in the future.

  • Security:
  • We adopt reasonable organizational, technical and administrative measures to protect all the information under our control. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the information.
  • Where you have chosen a password that allows you to access certain parts of the Sites, you are responsible for keeping this password confidential. We advise you not to share your password with anyone.
  • Unfortunately, no information transmission over the internet or data storage system can be guaranteed to be 100% secure. Although we will take steps to protect your information, we cannot guarantee the security of your information transmitted to the Sites; any transmission is at your own risk. Therefore, please do not send us sensitive information through email. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us.   • Third-Party:
  • This service may contain links to other websites or apps. If you click on a third-party link, you will be directed to that website or apps. Note that these external websites or apps are not operated by us. Therefore, we strongly advise you to review the privacy policy of these websites or apps. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. The inclusion of a link on the website or apps does not imply endorsement of the linked website or apps by us or by our affiliates.
  • Users are responsible for any third-party PII obtained, published, or shared through this application and confirm that they have the third-party’s consent to provide the information to Vroom.
  • Verifying, updating and amending personal information:

You can update your information at any time by logging-in to your profile page.

  • Delete your Account:

At Vroom, we provide you with the option to delete your profile at any time. Please note that if you have any pending transactions or outstanding amounts due, you will not be able to delete your account. Please complete all pending transactions and/or payments to delete your account. To delete your profile, please follow these steps:

  1. Open the app on your device.
  2. Navigate to the ‘Settings’ menu, typically found within your user profile section.
  3. Select ‘Account Info.’
  4. Click on the delete your account option.
  5. Follow the on-screen instructions to confirm and complete the deletion process.

Please note that deleting your profile will also delete your PII, however, we may be required to retain some of your information if we process it as part of our legal obligations, or in pursuit of our own (or a third-party’s legitimate interests) such as the assertion of, or defense against, legal claims, preventing fraud or protecting ourselves or others against abusive behavior. Once your information is deleted from the device, it will be permanently removed from our systems and cannot be recovered. If you have any questions, please contact us. (See contact section)

  • Retention time:

PII shall be processed and stored for as long as required by the purpose they have been collected for.

Therefore:

  1. PII collected for purposes related to the performance of a contract between Vroom and the user shall be retained until such contract has been fully performed.
  2. PII collected for the purposes of Vroom’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by Vroom within the relevant sections of this page or by contacting Vroom.

Vroom may be allowed to retain PII for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, Vroom may be obliged to retain PII for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, PII shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the expiration of the retention period.

  • Children’s Privacy:

Our Sites is neither for persons aged under 18, and nor do we intend to collect PII of Sites visitors who are aged under 18, unless they have the permission of a parent or guardian. However, we are unable to verify visitors’ age. We therefore advise parents to monitor their children’s online activities, so as to prevent their PII being collected without parental consent. If you feel that we have collected PII of a minor without consent, please contact us. We will then proceed to erase the information.

  • Privacy Policy amendment:

Vroom may update our privacy policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new privacy policy on the sites.

  • Severability:

If any part of these clauses is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these clauses and shall not affect the validity and enforceability of any of the remaining provisions. No waiver by Vroom shall be construed as a waiver of any preceding or succeeding breach of any provision.

  • Legal Information:

This privacy statement has been prepared based on provisions of applicable legislation and standards set by the State of Kuwait.

  • Governing Law and Jurisdiction:

This Policy shall be governed by and construed exclusively in accordance with the laws of the State of Kuwait. Any dispute, claim or controversy arising out of or in connection with the Agreement that cannot be settled amicably by the parties within thirty (30) days of its first occurrence shall be referred by any Party for adjudication by the competent court of the State of Kuwait.
